Terms of Use

Welcome to Modelstry. These Terms of Use ("Terms") govern your use of the Modelstry mobile application and related services (the "Service"), operated by Vibez Ink LLC.

1. Acceptance of Terms #

By accessing or using Modelstry, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility #

You must be at least 18 years old to use Modelstry. By using the Service you represent and warrant that you are at least 18.

3. Account Registration #

Certain features require an account. You agree to:

• Provide accurate and complete information
• Keep your credentials secure
• Keep your account information current
• Accept responsibility for all activity under your account

You may delete your account at any time from Settings → Delete Account.

4. Subscriptions and Payments #

Modelstry offers a free Basic tier and two paid subscription tiers. All purchases are processed by Apple through your Apple ID — we never receive your payment card details.

4.1 Subscription plans #

Prices shown in the app are the App Store's prices for your region and are what you will actually be charged. Prices are subject to change; we will notify you before any increase affects you.

4.3 Free trial #

New subscribers in the United States receive a 7-day free trial. Apple grants this trial once per subscriber across all Modelstry plans — not once per plan. If you have already used a Modelstry trial, purchasing a different plan will begin billing immediately.

Free trials are currently offered in the United States only. Subscribers in other regions are charged from the start of the subscription.

4.4 Auto-renewal and cancellation #

Please read this section carefully.

• Payment is charged to your Apple ID at confirmation of purchase.
• Your subscription renews automatically at the same price and duration unless you cancel it.
• To avoid being charged for the next period, you must cancel at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• If you have a free trial, cancelling at least 24 hours before it ends avoids any charge. Any unused portion of a free trial is forfeited when you purchase a subscription.

To cancel, go to iOS Settings → [your name] → Subscriptions → Modelstry → Cancel Subscription. You can also manage it in the App Store app under your account. Cancellation cannot be completed from within Modelstry, and deleting your Modelstry account does not cancel your subscription.

When you cancel, you keep access to paid features until the end of the period you have already paid for.

4.5 Plan changes #

You may switch between plans or durations at any time. Upgrades take effect immediately, with Apple applying any proration. Downgrades take effect at the end of your current billing period.

The following are one-time purchases that do not renew:

Purchases are processed by Apple, and refunds are handled by Apple under its own policies. We cannot issue refunds directly. Refund requests go to reportaproblem.apple.com.

5. User Conduct #

You agree not to:

• Post false or misleading information, or impersonate anyone
• Harass, abuse, threaten, or harm other users
• Use the Service for any illegal purpose
• Share sexually explicit content, or anyone's content without their consent
• Spam, solicit, or send commercial messages to other users
• Scrape, reverse-engineer, or interfere with the Service
• Circumvent tier limits or payment mechanisms

We may suspend or terminate accounts that violate these Terms.

6. Content #

6.1 Profile and gallery content #

• Photos of a person must be of you, or used with that person's permission
• No sexually explicit or otherwise inappropriate content
• No copyrighted material you do not have the right to use

6.2 Ownership and license #

You retain ownership of the content you upload. You grant Modelstry a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely for the purpose of operating and promoting the Service. This license ends when you delete the content or your account, except for copies already made by other users and for any copies retained in backups.

6.3 Reporting #

You can report a user or content from within the app. We review reports and act on them, which may include removing content or terminating accounts.

7. Matching and Messaging #

• Both users must match before a conversation can begin
• Swipe and conversation limits depend on your tier (see §4.2)
• Some messaging features require a paid subscription

8. Verification #

Verification badges indicate that a user submitted identity documentation we reviewed. A badge is not a guarantee of a person's identity, credentials, professionalism, or safety. Do not treat it as one.

9. Privacy #

Our Privacy Policy explains what we collect and how we use it, and forms part of these Terms.

10. Intellectual Property #

Modelstry, its name, logo, and the Service are protected by copyright, trademark, and other laws. These Terms grant you no right to use our branding.

11. Disclaimers #

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE MATCHES, BOOKINGS, EARNINGS, OR SUCCESSFUL COLLABORATIONS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability #

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Vibez Ink LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

13. User Interactions and Meetings #

This section is important. Please read it.

13.1 We are an introduction platform only #

Modelstry connects users within the app. We do not employ, represent, endorse, screen, or supervise any user, and we are not a party to any arrangement you make with another user.

13.2 No liability for anything off-platform #

MODELSTRY IS NOT LIABLE FOR ANY INTERACTION, MEETING, AGREEMENT, CONTRACT, OR ARRANGEMENT BETWEEN USERS THAT OCCURS OUTSIDE THE APP. This includes but is not limited to:

• In-person meetings, shoots, or collaborations
• Business contracts or agreements
• Payments or financial transactions between users
• Disputes arising from off-platform dealings
• Personal safety incidents
• Any damages, losses, or injuries resulting from meeting another user

13.3 Your responsibilities #

You are solely responsible for:

• Verifying the identity, credentials, and professionalism of anyone you deal with
• Conducting your own due diligence before meeting anyone or signing anything
• Your personal safety when meeting other users — meet in public, tell someone where you are going, and trust your instincts
• Any contract or business arrangement you make outside the app

14. Termination #

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violating these Terms or where required by law. Sections that by their nature should survive termination — including §6.2, §11, §12, and §13 — will survive.

15. Governing Law #

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules.

16. Changes to These Terms #

We may update these Terms. If changes are material we will notify you in the app or by email before they take effect. Continuing to use the Service after that constitutes acceptance.
